Flexible Leasing Terms and Conditions

ReLease provides flexible renting services that enable you to move at any time, for any reason from your ReLease-enabled rental unit (a ReLease Rental) within a defined period of time, and receive full or partial compensation from ReLease, as set forth in these Terms. These Terms govern our Flexible Leasing Platform (the Service). By purchasing the Service, either independently or through your building management, you agree to these Service Terms, ReLease's Terms of Service, and ReLease's Privacy Policy.
The Service is subject to the following requirements and restrictions:
- How it works. If you have purchased the Service for any ReLease Rental, you may move at any time and cancel the remainder of your lease agreement directly through the ReLease App and receive full or partial compensation from ReLease, as provided in the below paragraphs. Neither documentation nor reason will be required in order to move. After your specified timeframe has passed, the purchased Service will expire and any moves or cancellations related to your ReLease Rental will be subject to the rules imposed by your building management specified in your lease agreement.
- Valid Move for ReLease Lease Flexibility Coverage. Except as provided in Section 8, you must move out and have completed the required check-out in the ReLease App at least twenty-four (24) hours prior to the start of a billing period to receive full or partial compensation from ReLease for that billing period.
- Valid Cancellation for ReLease Lease Cancellation Coverage. Except as provided in Section 8, you must cancel your ReLease Rental in the ReLease App at least a specified period of time that will be made clear prior to purchasing prior to the move-in date specified in your lease agreement (the Move-In Date). This window is typically 90 days prior to the Move-In Date, and can be extended at time of purchase (e.g. 60 days or 30 days).
- Form of Compensation. Full or partial compensation of outstanding rent, up to the limit made clear to you prior to purchasing (the Limit), will be paid directly to your building management, as specified in your lease agreement. ReLease will reimburse any additional cancellation fees your building management may charge you on top of this compensation (the Cancellation Fees), upon request to customer support via the ReLease App.some textsome text
- Outstanding Rent. ReLease will pay directly to your building management any outstanding rent at the time of your move out, up to the Limit. If you received a promotional price or leasing incentives (e.g. one month free rent) when you signed your lease agreement that must be paid back to your building management upon early termination, ReLease will include this amount in compensation paid to your building management, subject to the same Limit, upon request to customer support via the ReLease App.
- Cancellation Fees. If your building management charges you Cancellation Fees after ReLease has paid compensation for Outstanding Rent, ReLease will reimburse you a percentage of the total amount of Cancellation Fees, upon request to customer support via the ReLease App. Regardless of the total amount of Cancellation Fees, the Service does not entitle you to a full refund of all costs. No additional expenses other than the Cancellation Fees will be reimbursed (including, for example, the Service fee, any other purchased items such as tenant insurance, administrative fees charged by your building management, or deposits charged by your building management).
- Compensation Timing. Payments by ReLease of compensation amounts will be processed within ten (10) business days either directly to your building management for Outstanding Rent, or to you directly via ACH transfer for reimbursements of Cancellation Fees.
- Modifications. If the lease agreement of your ReLease Rental has been modified or adjusted in any way after the purchase of the Services, the Service will apply only to the original amount and terms of the lease agreement provided at the time you purchased the Services.
- Good Standing. In order for the Services to be applied, you must be in good standing with ReLease and with your building management at the time you decide to move from or cancel your ReLease Rental in the ReLease App.
- Exclusions. The Service does not apply if, subsequent to your purchase, any of the following occur, based on the sole discretion of ReLease:some text
- a cancellation or termination of the lease agreement by your building management for any reason, including the result of a force majeure event.
- any voluntary move-out or cancellation requested by you directly with your building management of any lease agreements subject to the Service.
- the rental unit is deemed unfit for living, including but not limited to any scenarios where the unit fails to meet basic living standards or safety requirements due to reasons such as significant damage, health hazards, legal condemnations, or other circumstances rendering it unsuitable for habitation.
- Building management has breached the lease agreement and/or rental contract, or has failed to maintain the rental unit in a fit and habitable manner.
- the lease agreement is found to be illegal at any point during the coverage period, or any other circumstances where the tenancy is deemed unlawful.
- you or another resident of the rental unit are legally evicted for any reason during the coverage period.
- a declaration of an “emergency” or similar “extraordinary measures” taken by any governmental authority in the city, region, or country of your ReLease Rental
- a designation by the World Health Organization (WHO) that the city, country, or region of your ReLease Rental is at risk from COVID-19. In the event of such cancellation, or change, declaration of emergency, alert, notice, designation, or other similar government action, your purchased Service shall expire immediately and any compensation for your ReLease Rental will be subject to the rules and regulations imposed by your building management and relevant local authorities.
- Other Restrictions. The Service may only be purchased within 30 days of the time you signed your lease agreement, and may not be added after this window has expired, unless written approval has been provided by ReLease. The Service must be purchased for all residents of the rental unit. If there is more than one resident of the rental unit, the resident who purchased and/or activated the Service shall determine how to exercise the Service, which shall apply to any other resident included on the lease agreement. ReLease may not offer a Service to all ReLease Rentals. ReLease reserves the right to deny the purchase of the Service to any customer for any lawful reason. The Service is only valid for the lease agreement for which the Service was purchased. The Service is not transferable and cannot be carried over to any future lease agreements.
- Non-Refundable Service Fee. If you purchased ReLease Lease Flexibility Coverage, and move out before the end of your coverage period, you will receive a partial pro-rated refund of the fee you paid to purchase Service based on remaining unused time. In all other cases, including purchases of ReLease Lease Cancellation Coverage, the Service cost is non-refundable.
- Tenant Rights Regimes and Additional Information. Certain jurisdictions, including most states in the U.S., have adopted laws and/or regulations requiring building management to provide zero-cost early lease terminations to residents who meet specific eligibility criteria (e.g. you or another resident of the rental unit experience domestic violence, sexual violence or stalking, and they currently feel unsafe in their home or believe there is a risk to their safety, including physical, emotional or psychological safety, or the safety of their children if they stay in the rental unit). You may have rights under these Tenant Rights Regimes even if you do not purchase the Service. The value the Service provides is as a quick and easy way for you to move and receive compensation in the event you decide to move from or cancel your lease agreement, without having to go through your building management. - Not Insurance. The Service allows you to move from or cancel your lease agreement of a ReLease Rental at any time and for any reason within the Service Terms without incurring additional fees. ReLease provides its customers with the Service to provide a more seamless and flexible experience for rentals administered with the assistance of the ReLease App. The Service Terms are not an offer to insure, do not constitute insurance or an insurance contract, and do not take the place of insurance obtained or obtainable by you.
